Privacy Policy

This Privacy and Personal Data Protection Policy explains the terms under which Portugal Art Encounters ® processes the personal data of users (including in this designation, in particular, all visitors and participants in our activities), as well as the rights they may exercise, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council - General Data Protection Regulation (GDPR) – and other applicable national legislation on privacy and data protection.

To facilitate the understanding of this Policy, the following definitions are used:

3. Person Responsible for Processing Personal Data

Natural or legal person who determines the purposes and means of the processing of personal data.


 

4. Subcontractor

Natural or legal person who processes personal data on behalf of Portugal Art Encounters ®, in the context of the provision of services, formalized through a Contract.


 

5. Supervisory authority

An independent public authority which, in the case of Portugal, is the National Commission for Data Protection (CNPD), responsible for supervising the correct application of the legislation on personal data protection. 


 

6. Cookies

Computer files containing a sequence of numbers and letters that uniquely identify a user's internet access device, but may contain other information such as the user's browsing preferences on a given website. Cookies are downloaded through the browser to the internet access device (computer, cell phone, tablet, etc.) when accessing certain websites.


 

II. ENTITY RESPONSIBLE FOR DATA PROCESSING

Portugal Art Encounters ® is responsible for data processing.


 

III. DATA PROCESSED

Portugal Art Encounters ® processes the personal data it collects in the scope of the commercial and advertising relationship established with users for its artistic, cultural, and scientific activities, and in compliance with the applicable legal and regulatory obligations. 


 

IV. PRINCIPLES OBSERVED

Portugal Art Encounters ®'s data processing observes the principles of lawfulness, fairness and transparency; purpose limitation; data minimization; accuracy; limitation of storage; integrity, confidentiality and responsibility.


 

V. BASIS FOR DATA PROCESSING

In the pursuit of its activity, the processing of data that Portugal Art Encounters ® carries out is framed within determined, explicit and specific purposes, being assured the duties of information to the data subjects.

Such processing is based on:

  • in compliance with legal obligations;
  • in the performance of contracts to which the data subjects are party or in pre-contractual steps at their request;
  • in pursuit of the legitimate interests of Portugal Art Encounters ®;
  • and also with the consent of the data subject. 


 

VI. SUBCONTRACTORS

Portugal Art Encounters ®, in the pursuit of its activity, may use third parties - Subcontractors - for the rendering of certain services, which may imply access, by these third parties, to personal data of the data subjects. Portugal Art Encounters ® ensures that in these circumstances the appropriate technical and organizational measures are adopted in order to ensure that the subcontracted entities meet the applicable legal requirements and offer adequate guarantees in matters of data protection.


 

VII. RIGHTS OF THE HOLDERS OF PERSONAL DATA

Portugal Art Encounters ® guarantees the data subject, at all times, all rights arising from the legislation on the protection of personal data, including the rights of access, updating, rectification, forgetfulness, limitation of processing or deletion of personal data and, where applicable, the right of data portability.

The data subject may at any time revoke, reduce the scope or limit the extent of any consent previously given, without prejudice to the lawfulness of the processing previously carried out.

Users are also entitled to lodge complaints with the National Data Protection Commission.

IX. DATA RETENTION

Portugal Art Encounters ® complies with the legal rules regarding the time limits for the conservation of personal data, and may keep them

(a) Until the end of the legal period established after the end of the contractual relationship;

b) While there are still obligations arising from the contractual relationship;

c) As long as Portugal Art Encounters ® may be entitled to enforce its rights.

Whenever there is no specific legal requirement, the data will be stored and kept only for the minimum period necessary for the purposes for which they were collected and subsequently processed.


 

X. SECURITY MEASURES

Portugal Art Encounters ® guarantees adequate levels of security and protection of the personal data of data subjects. To this end, it adopts several technical and organizational security measures in order to protect personal data against loss, disclosure, alteration, unauthorized processing or access, as well as against any other form of unlawful processing. 


 

XI. USE OF COOKIES 

Portugal Art Encounters ® uses cookies to improve the performance and browsing experience of the holders of personal data, increasing, on the one hand, the speed and efficiency of response and, on the other, eliminating the need to repeatedly enter the same information.

The user can accept, refuse or remove cookies by managing the settings of their browser, and the user is always given the opportunity to change their permissions.


 

XII. CHANGES TO PRIVACY POLICY AND COOKIES

Portugal Art Encounters ® may update or make adjustments to this Privacy and Cookies Policy, and these changes will be duly disclosed.
